TERMS OF SERVICE & CONDITIONS OF USE

These Terms of Service and Conditions of Use (the “Terms”) govern your access to and use
of the website, online booking system, intake forms, and mobile dog fitness services
(collectively, the “Services”) provided by WANNA RUN K9 CLUB LLC, a Florida limited
liability company (“Wanna Run K9 Club,” “Company,” “we,” “us,” or “our”).
By accessing, booking, or using the Services, you agree to be bound by these Terms. If you
do not agree, you must not use the Services.
1. Acceptance of These Terms
By using the Services, you represent and warrant that you:
• Are at least eighteen (18) years of age and legally capable of entering into binding
contracts;
• Are the legal owner or authorized caretaker of the dog(s) for which Services are
booked; and
• Have read, understood, and agree to be bound by these Terms, our Privacy Policy,
and any required waivers or intake forms.
2. Services Provided
Wanna Run K9 Club LLC operates mobile, climate-controlled canine fitness units offering
services that may include, but are not limited to:
• Dog-powered treadmill exercise sessions;
• Conditioning, enrichment, and structured fitness programs; and
• Weight management and activity plans.
Service offerings, availability, pricing, equipment, service areas, and scheduling may
change at any time without prior notice.
3. Bookings, Cancellations & No-Shows
3.1 Booking
Sessions may be booked online, through third-party scheduling platforms, or by phone. All
bookings are subject to availability and confirmation. We reserve the right to refuse,
cancel, or discontinue Services at our sole discretion, including for safety, health, or
behavioral concerns.
3.2 Cancellations & Rescheduling
Cancellations or rescheduling requests must be made at least twenty-four (24) hours prior
to the scheduled session time. Late cancellations may be charged up to the full session
fee.
If we must cancel due to weather, vehicle or equipment issues, safety concerns, or other
circumstances beyond our reasonable control, we will make reasonable efforts to
reschedule at no additional cost.
3.3 No-Show Policy
If we arrive at the scheduled location and are unable to access your dog due to owner
unavailability, locked access, or the dog being unavailable, the session may be treated as a
no-show and charged in full.
4. Fees, Payments & Packages
4.1 Pricing & Payment
Pricing is displayed at the time of booking and is subject to change. Payment is due at
booking or at the time of service, depending on the option selected. You authorize Wanna
Run K9 Club LLC and its payment processors to charge the payment method provided for
all fees incurred.
4.2 Packages & Expiration
Multi-session packages may include expiration dates disclosed at the time of purchase.
Unused sessions after expiration may be forfeited and are non-refundable unless
otherwise required by law.
4.3 Refunds
Refunds are considered on a case-by-case basis at the sole discretion of Wanna Run K9
Club LLC and are not guaranteed.
4.4 Memberships & Subscriptions
We may offer recurring monthly membership or subscription-based Services
(“Memberships”). By enrolling in a Membership, you authorize Wanna Run K9 Club LLC to
charge your selected payment method on a recurring monthly basis until the Membership
is canceled in accordance with this section.
Membership fees are billed in advance and are non-refundable except as required by law.
Membership benefits, included sessions, pricing, and terms will be disclosed at the time of
enrollment and may vary by plan.
Unused sessions included in a Membership do not roll over to future billing periods unless
expressly stated in writing. Missed sessions, no-shows, or late cancellations are forfeited
and are not eligible for credit or refund.
You may cancel a Membership by providing at least seven (7) days’ written notice prior to
your next billing date. Cancellations received after this deadline will take effect at the end
of the following billing cycle.
Wanna Run K9 Club LLC reserves the right to modify Membership pricing, benefits, or
availability upon reasonable advance notice. Continued participation after such notice
constitutes acceptance of the updated Membership terms.
5. Dog Health, Behavior & Eligibility
5.1 Health Requirements
By booking Services, you represent and warrant that your dog:
• Is at least five (5) months of age, unless otherwise approved by us in writing;
• Is up to date on vaccinations as recommended by a licensed veterinarian;
• Is free from contagious illness, parasites, or conditions that could endanger people
or other animals; and
• Is physically capable of participating in exercise activities or has veterinary approval
for modified activity.
5.2 Behavior Disclosure
You must disclose any history of aggression, biting, reactivity, or behavioral concerns.
Wanna Run K9 Club LLC reserves the right to refuse or terminate Services if, in its
judgment, a dog poses a safety risk to itself, our staff, or others.
The Company reserves the right to refuse or discontinue Services to any dog displaying
aggressive or unsafe behavior, including service animals, if such behavior poses a direct
threat to the health or safety of staff, clients, or other animals, as permitted by applicable
law.
5.3 Veterinary Care & Emergency Authorization
Wanna Run K9 Club LLC does not provide veterinary services. In the event of a medical
emergency, you authorize us to attempt to contact you and your designated veterinarian
and, if immediate action is required and you cannot be reached, transport your dog to the
nearest appropriate veterinary facility and authorize reasonable emergency treatment if
you cannot be reached.
All veterinary costs, treatment decisions, and outcomes are solely your responsibility. We
make no guarantees regarding medical outcomes and are not obligated to advance
payment for veterinary care.
6. Assumption of Risk
You acknowledge that canine fitness activities involve inherent risks, including but not
limited to physical exertion, use of specialized equipment, environmental conditions,
fatigue, injury, illness, or unforeseen medical events.
You knowingly, voluntarily, and expressly assume all risks associated with your dog’s
participation in the Services, whether known or unknown, to the fullest extent permitted by
Florida law.
7. Release, Indemnification & Hold Harmless
To the fullest extent permitted by law, you agree to release, waive, indemnify, defend, and
hold harmless Wanna Run K9 Club LLC, its owners, members, employees, contractors,
and agents from any and all claims, demands, damages, losses, liabilities, costs, and
expenses (including reasonable attorneys’ fees) arising out of or related to:
• Your dog’s participation in the Services;
• Any injury, illness, loss, or damage involving your dog;
• Your failure to disclose health or behavioral conditions; or
• Any acts or omissions by you, your dog, or any minor or third party acting on your
behalf,
including claims arising from the negligence of Wanna Run K9 Club LLC, except to the
extent prohibited by applicable law.
8. Limitation of Liability
To the maximum extent permitted by law:
• Wanna Run K9 Club LLC shall not be liable for any indirect, incidental, special,
consequential, or punitive damages; and
• Our total aggregate liability for any claim, incident, or occurrence shall not exceed
the amount paid for the specific session or package giving rise to the claim.
This limitation does not apply to liability that cannot be limited under Florida law, including
gross negligence or intentional misconduct.
9. Media & Social Media Consent
Unless you opt out in writing, you grant Wanna Run K9 Club LLC permission to photograph
or record your dog during Services and to use such images or videos for marketing,
promotional, and educational purposes, including on our website and social media
platforms.
No compensation will be provided. Content may be shared by third parties. Revocation of
consent applies prospectively only and does not require removal of previously published
content.
10. Website Use & Intellectual Property
All website content, graphics, logos, text, and materials are owned by or licensed to Wanna
Run K9 Club LLC and are protected by applicable intellectual property laws. You may not
reproduce, distribute, or exploit such content without prior written consent.
You agree not to use the Website for unlawful purposes or in any manner that could
damage or impair our systems.
11. Disclaimer of Warranties
The Services and Website are provided on an “as-is” and “as-available” basis without
warranties of any kind, express or implied, including but not limited to warranties of
merchantability, fitness for a particular purpose, or non-infringement.
12. Privacy
Your use of the Services is subject to our Privacy Policy, which is incorporated by reference.
13. Governing Law, Venue & Arbitration
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-
law principles.
You agree to first attempt informal resolution. If unresolved, any dispute shall be resolved
by binding arbitration administered by the American Arbitration Association and
conducted in Indian River County, Florida.
You understand and agree that you are waiving the right to a trial by judge or jury. Each
party shall bear its own arbitration costs unless otherwise required by law.
Arbitration shall be conducted on an individual basis and not as a class action or collective
proceeding.
Small claims matters may be brought in a court of competent jurisdiction.
14. Miscellaneous
• Severability: If any provision is held unenforceable, the remainder shall remain in
effect.
• Force Majeure: We are not liable for delays, cancellations, or failures in
performance caused by events beyond our reasonable control, including but not
limited to severe weather, natural disasters, traffic conditions, governmental
actions, power outages, mechanical failure, vehicle malfunction, equipment failure,
or other unforeseen circumstances affecting our mobile operations.
• Assignment: We may assign these Terms without restriction. You may not assign
without written consent.
• Entire Agreement: These Terms constitute the entire agreement between you and
Wanna Run K9 Club LLC.
• Updates: Continued use of the Services constitutes acceptance of revised Terms.
